The Netherlands Introduces A Statutory Ban On Inducement Related To Medical Devices

Gifts to physicians. Sponsoring of scientific conferences. Advisory boards. Up until recently, such relations between medical devices companies and healthcare professionals were not regulated by law in the Netherlands. As of 1 January 2018 a statutory ban on improper inducements regarding medical devices applies in the Netherlands. Further guidance is provided by the Ministry of Health in the form of policy rules, which provide guidance and interpretation regarding the ban on inducement and the exceptions thereto (hereinafter referred to as the ‘policy rules’) and a Q&A document.
